1. Agreement to Terms

By accessing or using ApplyFast (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

2. Description of Service

ApplyFast is an AI-powered job search automation platform. The Platform scans job boards, evaluates job listings against your profile, tailors resumes and cover letters, and optionally auto-applies to jobs on your behalf. Features include:

Resume parsing and structured data extraction
AI-powered job matching with A–F grade scoring and explanations
Visa-aware filtering using H1B sponsor history data
AI resume tailoring and cover letter generation
Automated job application submission (Pro tier only)
Application tracking dashboard

3. Eligibility

You must be at least 13 years old to use the Platform. By creating an account, you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

4. Account Terms

One account per person. Creating multiple accounts to circumvent usage limits is prohibited.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate, current, and complete information during registration and to update your information as needed.
Notify us immediately of any unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

Abuse the auto-apply feature to spam employers or submit fraudulent applications
Upload fake resumes, fabricated credentials, or misleading professional information
Use automated tools to scrape, crawl, or bulk-download content from the Platform
Attempt to gain unauthorized access to other users’ accounts or our systems
Circumvent usage limits, rate limits, or access-control features
Use the Platform for any unlawful purpose or in violation of applicable laws
Resell or redistribute access to the Platform or its features

6. Payment Terms

6.1 Subscription Plans

ApplyFast offers three tiers: Free ($0), Student ($12/month or $29/3 months), and Pro ($24/month or $59/3 months). Plan features and limits are described on our pricing page and may be updated from time to time.

6.2 Billing

Subscriptions are billed monthly or per 3-month bundle through Stripe. By subscribing, you authorize recurring charges to your payment method. You can cancel at any time — access continues until the end of your current billing period.

6.3 Refund Policy

We offer a full refund within 7 days of purchase if you have submitted fewer than 5 applications through the Platform. After that, no refunds are issued — you may cancel your subscription instead.

6.4 Plan Changes

If you downgrade from Pro to Student, auto-apply stops immediately. Existing application tracking continues. Usage credits reset to the new plan’s limits at your next billing cycle. No overage charges are applied — when credits run out, features are gated until the next billing cycle or upgrade.

7. Intellectual Property

7.1 Your Data

You retain full ownership of your personal data, resumes, and professional information. By using the Platform, you grant us a limited license to process this data solely to provide the services described in these Terms.

7.2 AI-Generated Content

Tailored resumes, cover letters, and other content generated by our AI belong to you. You are free to use, modify, and distribute them as you wish. You are responsible for reviewing AI-generated content for accuracy before submission.

7.3 Our Platform

The Platform, including its design, code, algorithms, and branding, is owned by ApplyFast and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the right to use the Platform as intended.

8. Disclaimers

8.1 No Guarantee of Results

ApplyFast is a job search tool, not an employment agency. We do not guarantee that you will receive interviews, job offers, or employment. Results depend on your qualifications, the job market, and many factors outside our control.

8.2 AI Accuracy

AI-generated match scores, resume tailoring, and cover letters are provided as assistance, not guarantees. Always review AI-generated content before use. We are not responsible for errors or omissions in AI-generated materials.

8.3 Visa Information

H1B sponsor data is sourced from public U.S. Department of Labor records and is provided for informational purposes only. It does not constitute legal advice. Consult an immigration attorney for guidance on your specific visa situation.

8.4 “As Is” Service

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ApplyFast and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or employment opportunities, arising out of or related to your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ApplyFast from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, the content of applications you submit, or your violation of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion for violation of these Terms. You may delete your account at any time through your account settings. Upon account deletion, all personal data (resume, applications, preferences) is deleted within 30 days. Anonymized usage analytics are retained.

Free accounts inactive for 6 months will receive a warning email at 5 months. If no login occurs, the account and data are deleted at 6 months.

12. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with applicable rules, unless prohibited by law.
